Tulikivi Warranty terms
TULIKIVI U.S., INC. LIMITED WARRANTY AND DISCLAIMER from 1 January 2023
TULIKIVI U.S., INC warrants to the original purchaser of its Fireplaces, Bakeovens and Cookstoves (“Fireplace products”) that these fireplace products will be free of defects in materials and workmanship for a period of five (5) years under normal home use and service. The full limited expressed warranty is set forth below.
TULIKIVI U.S., INC warrants to the original purchaser that the fireplace products manufactured by TULIKIVI U.S., INC shall be free of defects in material and workmanship under normal home use and service. TULIKIVI U.S., INC’s obligation under this warranty shall be limited to the repair or exchange of any part or parts that are defective and brought to TULIKIVI U.S., INC’s attention within five (5) years from the date of installation by the original purchaser. Labor charges on defective parts to the original purchaser will be waived and covered under the TULIKIVI U.S., INC/Dealer labor policy in effect at the time of the claim. Repairs must be made by an authorized TULIKIVI U.S., INC dealer or representative. All defective parts must be returned to TULIKIVI U.S., INC or held for TULIKIVI U.S., INC’s inspection. This Limited Warranty applies only if your TULIKIVI U.S., INC fireplace product is installed by a TULIKIVI U.S., INC authorized installer and is used for normal home use. With the installation and connection of Tulikivi Green products, in addition to given instructions, also national and regional instructions must be followed. Your TULIKIVI U.S., INC Owner Registration Card must be filled by an authorized TULIKIVI U.S., INC installer and returned to TULIKIVI U.S., INC within thirty (30) days after installation. Fireplace and bakeoven door glass, metal, cast iron and ceramic parts, thermometer, gaskets and Tulikivi-Green products (such as heat exchangers, electric components, control and measuring components) are not covered by this Limited Warranty. In addition, small hairline cracks in the soapstone, although unusual, may occur, but these are normal in natural material such as soapstone and are not defects covered by this Limited Warranty.
THE WARRANTY SET FORTH ABOVE IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED. TULIKIVI U.S., INC DISCLAIMS ANY WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH REGARD TO THE FIREPLACE PRODUCTS SOLD BY IT OR ANY DEALER, INCLUDING ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR IMPLIED WARRANTY OF MERCHANTABILITY BEYOND THE SCOPE OF THE WARRANTY SET FORTH ABOVE AND EXCEPT AS MAY BE PROHIBITED BY APPLICABLE LAW.
THE WARRANTY SET FORTH ABOVE SHALL NOT APPLY TO THIS TULIKIVI U.S., INC FIREPLACE PRODUCT OR ANY PART THEREOF THAT HAS BEEN SUBJECT TO NEGLECT, ABUSE, ALTERATION, IMPROPER INSTALLATION, MISUSE, OR USE CONTRARY TO THE INSTRUCTIONS IN THE OWNER’S MANUAL. TULIKIVI U.S., INC OTHERWISE TAKES NO WARRANTY WHATSOEVER IN RESPECT TO ACCESSORIES OR PARTS NOT SUPPLIED BY IT.
The Original Purchaser hereby acknowledges that it understands and agrees that, except as may be prohibited by law, ALL TULIKIVI U.S., INC FIREPLACE PRODUCTS ARE PURCHASED “AS IS”, AND THAT SUBSEQUENT TO THE FIVE (5) YEAR PERIOD DURING WHICH THE LIMITED WARRANTY DESCRIBED ABOVE IS IN EFFECT THE ENTIRE RISK AS TO QUALITY AND PERFORMANCE OF THE FIREPLACE PRODUCTS RESTS WITH THE ORIGINAL PURCHASER. THE ORIGINAL PURCHASER (NOT TULIKIVI U.S., INC OR ITS DEALER) SHALL ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR FOR ANY DEFECT NOT BROUGHT TO TULIKIVI U.S., INC’s ATTENTION WITHIN FIVE (5) YEARS FROM THE DATE OF PURCHASE BY THE ORIGINAL PURCHASER. TULIKIVI U.S., INC NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY LIABILITY IN CONNECTION WITH THE SALE OF THIS TULIKIVI U.S., INC FIREPLACE PRODUCT, EXCEPT AS EXPRESSLY SET FORTH HERE IN. TULIKIVI U.S., INC DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, AS WELL AS ALL LIABILITY FOR ANY DAMAGES, INCLUDING CONSEQUENTIAL, SPECIAL, INCIDENTAL OR ANY OTHER DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM THIS FIREPLACE PRODUCT.
The term, “original purchaser”, as used in this warranty shall be deemed to mean that person for whom the TULIKIVI U.S., INC fireplace product was originally purchased.
