Terms of warranty – Fireplaces
in Finland
From 1 October 2023

 

Tulikivi complies with the relevant local legislation concerning consumer protection and product liability. 

Tulikivi grants a five-year (5) limited warranty to products sold under the Tulikivi brand, provided that the customer fills in the electronic warranty card on the Tulikivi website at https://warm.tulikivi.fi/fi-en/warranty-registration-register-your-own-fireplace as follows: 
•    Soapstone fireplaces Karelia, Jero and Classic
•    Ceramic fireplaces Kermansavi
•    Stone components of convection fireplaces Pielinen and wood stoves

Without registration the warranty is two (2) years.

The products listed below are not covered by the three-year (3) additional warranty granted by Tulikivi: 
•    Fireplace doors, glass, seals and all their structures
•    Fireplace metal, electrical and electronic components
•    Firebox and slow cook oven panels
•    Tulikivi Green accessories (e.g. electrical elements, control and measurement systems)
•    Chimney fans
•    Sauna stoves (woodburning stoves, electric sauna heat-ers and their control devices)

Tulikivi grants a limited one-year (1) warranty for the following products and their components:
•    Metal parts, door glasses, seals, firebox panels and grates for convection fireplaces and wood stoves
•    A condition for the above-mentioned warranty terms is that the product must be used in accordance with the specifications.

Cooking products are not covered by the warranty. 

The warranty card must be completed immediately after the product has been installed.

The warranty only covers fireplaces installed in Finland. For the warranty to be valid, the fireplace must be installed according to the specification given and in accordance with official regulations and the product must be used in accord-ance with the instructions given by Tulikivi. The warranty shall enter into force as of the date of installation of the fireplace body. The warranty consists of a quality warranty and an operation warranty. If the location of the product is changed after initial installation the warranty is no longer valid.

Repairs made during the warranty period do not extend the warranty period granted to the product.

For the warranty to be valid in the case of convection fireplaces and wood stoves, the installation must be carried out in accordance with all the specifications and regulations issued and the operating manual must be followed.


Maintenance service (subject to a charge)

Tulikivi grants a two-year (2) warranty for stone components and equipment sold through the maintenance service.
•    Fireplace stone components
•    Fireplace doors, glass, seals and all their structures
•    Fireplace metal, electrical and electronic components
•    Firebox and slow cook oven panels
•    Tulikivi Green accessories (e.g. electrical elements, control and measurement systems)

Quality warranty
The quality warranty shall cover any faults emerging during the warranty period caused by raw materials or manufacturing defects free of charge. The warranty does not cover colour variations, stratification and minor hairline fractures that are characteristic of natural stone or cracks in the coating, where these do not affect the safety or operation of the fireplace. The warranty does not cover colour changes to the textured surface that appear near the firebox of ceramic fireplaces. Neither does the warranty cover loss or damage caused by normal wear and tear or incorrect usage, or surface discolouration. The warranty does not cover any minor cracks that may appear in the mortar surfaces, in joints between tiles or in internal parts of ceramic products, where these do not affect the safety or operation of the fireplace. The best way to avoid these minor aesthetic problems is by carrying out the initial heating of the fireplace carefully, following the specifications. The defects referred to above may arise if the fireplace is heated too much. The quality warranty does not cover natural colour variations in stoneware tiles and individual colour spots that differ from the main colour that meet production quality requirements. Colour differences are possible in stoneware tiles made from natural materials.

Operation warranty
Tulikivi guarantees the operation of a product installed in accordance with the installation specifications and used in accordance with theoperating manual. The operating warranty is only given to those Tulikivi soapstone and ceramic fireplaces, and convection fireplaces and wood stoves that have been installed by an authorised Tulikivi fireplace installer. Installation defects are the responsibility of the masonry company responsible for the installation. If the installation is carried out by someone other than an authorised Tulikivi fireplace installer, the product will not be granted an operation warranty. A condition of the operating warranty is that the flue to which the fireplace is connected meets the requirements set by the factory. A further condition for the operating warranty is that there is no significant low pressure in the room where the fireplace is located and that sufficient supply of combustion air has been ensured. Any installation or connection faults in the electrical element series with regard to the fireplace are the responsibility of the Tulikivi fireplace installer. The operating warranty does not cover any defects that come under the responsibility of the Tulikivi fireplace installer or the HPAC installer, and in the case of such defects, the customer must contact the Tulikivi fireplace installer or HPAC installer who carried out the installation or connection.

Limitations of warranty liability
Tulikivi is liable for defects in the products in accordance with the provisions on liability for defects in the Consumer Protection Act when the customer is a consumer as referred to in the Consumer Protection Act.

The customer must notify the seller of the product’s defect within a reasonable time after having detected the defect. In order to ensure prompt investigation of the defects, Tulikivi recommends that the customer notify Tulikivi of the defect immediately after having detected the defect.

Natural colour variations are a characteristic of stoneware tiles. Colour variations and stratifications are characteristic of natural stone and these are not considered product defects. Hairline fractures or cracks in the coating, which do not affect the safety or functioning of the fireplace, are not considered to be defects either. Textured surfaces are produced individually by hand and the quality of these, as with other surfaces (natural stone, tiles, seals, etc.) is assessed from a viewing distance of two metres. There are variations on the surfaces due to the material.

Tulikivi shall not be liable for defects or damage that are caused by installation or use that is contrary to the manufacturer’s instructions, by neglect of maintenance or the placement of the product in a location where the conditions do not correspond with the manufacturer’s recommendations. Tulikivi is only liable for indirect loss if the damage was caused by Tulikivi’s negligence.

The Tulikivi fireplace installer who has performed the installation shall be responsible for the quality of the installation work and for any defects detected therein. 
During the limited one-year (1) warranty, Tulikivi will deliver a new part to replace a broken one, but the warranty will not compensate the costs of the installation. The replacement part will not extend the warranty period.

Delivery without installation
Some of the convection fireplaces and wood stoves and soapstone and ceramic fireplaces sold under the Tulikivi brand can be delivered without installation. We do not grant an operation warranty for these fireplaces. See the section ‘Operation warranty’. For products sold without installation, the warranty period shall enter into force on the date of delivery. Tulikivi is not liable for the installation defects of an external installer, nor for damage caused to materials due to incorrect installation. We recommend that all heat-retaining fireplaces are always installed by a Tulikivi fireplace installer. 

Notification of defects 
Any defects covered by warranty must be reported immediately as soon as they arise, but no later than within 14 days. The fireplace serial number or order number must always be provided when reporting defects. The warranty does not cover any defects that have not been reported to Tulikivi during the warranty period. The fireplace must not be used before the defect has been repaired or Tulikivi has given permission to use the fireplace.

If the reported defect is not caused by the Tulikivi product or by incorrect installation work carried out by a Tulikivi fireplace installer, but is caused, for example, by ventilation that has been adjusted wrongly, the customer will compensate the costs arising from the fireplace installer’s unnecessary visit in accordance with an invoice sent by Tulikivi.

Under the Finnish Consumer Protection Act, the consumer has the right to claim, within a reasonable time after purchase, that there was a defect in the goods at the time of purchase (Consumer Protection Act, chapter 5, section 16).

Force majeure
The seller is released from fulfilling his/her obligations under the contract if the fulfilling of the obligation is prevented by an impediment beyond the seller’s influence, the consequences of which the seller could not reasonably have avoided and is unable to overcome without excessive additional costs.

Such an impediment is considered to be, for example, fire, natural events, strike, lockout, war, interruption of public transport or energy supply, damage to production equipment and official measures restricting imports or exports, or a significant shortage of materials, which, for a significant reason independent of the party, prevents or unreasonably hinders (results in excessive time wasting or costs) the fulfilment of the contract. The delay of a subcontractor used by the seller
is a grounds for release if the delay is due to a corresponding reason to those listed above that pose an impediment to the seller, and the subcontracting cannot be carried out elsewhere without excessive time wasting or costs.

The seller shall immediately notify the buyer of the force majeure and its effect on the performance of the obligations under the contract, as well as of the cessation of the force majeure, after which the parties shall agree on a new delivery

The product-specific heating areas specified are indicative. The heating area refers to a single area that meets the valid insulation and building technology requirements. 

Technical alterations
For reasons of continuous product development Tulikivi reserves the right to make changes to products.
